HYDERABAD: A two-judge bench of the Telangana High Court on Monday dismissed a habeas corpus writ petition seeking custody of a seven-year-old girl. The bench, comprising Justice Abhinand Kumar Shavili and Justice Pulla Karthik, was dealing with a petition filed by Sista Narasimha Shastry, who sought custody of his seven-year-old daughter who is presently staying with the mother.
The child was produced in court and was asked with whom she would like to reside. The girl chose to live with her mother. The court also observed that a petition for restitution of conjugal rights was filed in the district court by the mother. The bench observed that the child residing with the mother by choice was not an illegal detention of the child and dismissed the petition.
