Koti Women's College Heritage Building: Court Enlarges Time

A two-judge bench of the Telangana High Court, comprising Chief Justice Alok Aradhe and Justice T. Vinod Kumar, granted four weeks’ time to the state government to take a decision on restoring the rich heritage of British Residency at Koti Women's College. The bench was hearing a suo moto PIL registered on the basis of a letter addressed to the Chief Justice by Vasanta Sobha Turaga. The bench on an earlier occasion had taken note that restoration work was being carried out at the said premises and called for a detailed report. On Monday, the government pleader contended that the report is filed, and they are awaiting sanction of Rs 16 crore for complete restoration of the said heritage structures, and the government is expected to take a decision soon. Considering the submission, the bench directed the state to take a decision on the sanction of '16 crore to restore the original glory of the British Residency and posted the matter after four weeks.

HC stalls punitive actions against Ahmed Memorial Educational Society

Justice N.V Shravan Kumar of the Telangana High Court made clear that no coercive steps will be taken against Ahmed Memorial Educational Society until compensation is paid in accordance with law. The judge was hearing a writ plea filed by the society. The petitioner contended that the authorities are bound to follow the procedures under the law and acquire lands in accordance with the Land Acquisition Act, it is not feasible to take over the land by negotiations. The petitioner complained that though negotiations have failed without recourse to proceedings under Land Acquisition Act, the authorities were threatening to dispossess them and take possession.

Ankushapur village layout: HMDA gets time

A two-judge of the Telangana High Court, comprising Chief Justice Alok Aradhe and Justice T. Vinod Kumar, tapped the time to the HMDA to consider the grant of a fresh layout at Ankushapur village, Ghatkesar. The bench modified an earlier order passed in this regard by a single judge. Earlier, a single judge of the court had directed HMDA to issue notices to the claimants and after hearing them, decide the validity of the layout granted in April 2o18 in respect of land admeasuring Ac.4.26 guntas in Ankushapur village, and till such inquiry is conducted, the respondents are directed not to release any final layout on the subject property in favour of the petitioners. It was contended in the appeal that the authorities were not implementing the order under the pretext that it was ambiguous. It had failed to give proper notice or kick-start the process as directed by the single judge. The bench did not alter substantially the order of the single judge except in fixing an outer time limit for HMDA to act. The bench granted three months’ time to HMDA to complete the process.

HC appoints advocate commissioner in Warangal Govindaraj Swamy temple case

Justice C. Sumalatha of the Telangana High Court on Monday appointed an advocate commissioner to submit his report with regard to a disputed land adjacent to Govindaraj Swamy temple in Warangal district. The judge was hearing a writ petition filed by Vijaya Kumar, a resident of Warangal, complaining that the endowment department, using political influence, was encroaching upon the land of the petitioner. It is contended that the temple management overnight constructed a wall restricting access to the property of the petitioner. It was argued that in spite of an ongoing survey ordered by the endowment tribunal, the endowment department, which is state machinery, is being misused. Counsel for the department stated that the survey has taken place in the presence of the petitioners and the survey report has been completed and the sub-division report is pending. The judge granted interim relief directing the endowment department to grant access to the petitioner and appointed an advocate commissioner for the fair procedure for the survey and report to be filed by August 25.

Art teachers exam in Telugu: HC admits writ

Justice P. Madhavi Devi of the Telangana High Court called upon the state government to explain its failure to conduct an examination for the post of art teacher in Telugu language. The judge took on file a writ plea by G. Vinod challenging the action of state functionaries in not conducting the examination for the post in Residential Educational Institutions Societies, scheduled for this month, in Telugu. The petitioner contended that the action to exclude Telugu was contrary to the notification, arbitrary, and violates the principles outlined in Article 14 and Schedule VIII of the Constitution of India. The petitioner contended that Telugu should be given preference as given to English. The government is required to respond by August 23. The judge, however, made it clear that in case of an unsatisfactory explanation of the examination conducted by TREIRB on August 1, 2023, there is a risk of cancellation.

Supply answer script: TSPSC told

Justice P. Madhavi Devi of the Telangana High Court directed the Telangana Public Service Commission (TSPSC) to furnish an OMR sheet to a candidate who was refused the facility. The judge was dealing with a writ plea filed by G. T. Srilatha challenging the TSPSC decision in rejecting the representation for furnishing the OMR sheet, made in May. The petitioner contended that the denial of their request was illegal and unjust. After hearing the contentions of the counsels, the court directed the commission to furnish a copy of the petitioner's OMR sheet within a week.
