Government Should give priority to ADR process: Justice Nageshwara Rao

HYDERABAD: Supreme Court former judge, Justice Lavu Nageshwara Rao, urged governments to give priority to mediation and arbitration procedures as part of the dispute resolution mechanism by providing facilities and legislating statutes.

Justice Nageshwara Rao was appreciative of the Telangana state government’s work in this regard and said it had provided a “wonderful infrastructure” to the courts and the judicial system. He said that Telangana state was heading in the direction of alternative dispute resolution (ADR).

Justice Nageshwara Rao was speaking at a ‘fireside chat’ organised by the International Arbitration and Mediation Centre (IAMC) on how efficient ADR processes contribute to the common good.

V.K. Rajah, Singapore Supreme Court former judge, Chief Justice of Telangana High Court Justice Ujjal Bhuyan and minister K.T. Rama Rao participated.

Rama Rao said that the Telangana government was aware that MSMEs were facing difficulties related to disputes and delayed payments and had set up facilitation councils at Hyderabad and created decentralised councils at places like Warangal, Karimnagar and Nizamabad.

He said that he comes across instances of litigation getting prolonged even in these facilitation councils. So that government will align the functioning of these councils with the IAMC and ensure that an ADR mechanism is tried out.

Chief Justice Ujjal Bhuyan said that businesses were still in the shadow of governments. When they come out of the shadow and become corporate in the true sense, then parties will seek institutional arbitration. This will strengthen the economy and contribute to good governance.
