Hyderabad: Insurance firm to pay Rs 3 lakh fine

The insurance company had avoided processing the claim though the complainant had submitted the required documents, the Forum said.

Hyderabad: The Hyderabad Consumer Disputes Redressal Forum directed the National Insurance Company Limited to pay a fine of Rs 3 lakh for deficiency in their services. The insurance company had avoided processing the claim though the complainant had submitted the required documents, the Forum said.

Mr Amitra Sudan Kar obtained a policy from the National Insurance Company Limited, in the name of his entire family, including his mother Belu Kar. As his mother was suffering from pneumonia, he admitted her to Apollo Gleneagles Hospital, Kolkata, and shelled out `2 lakh for treatment. Subsequently, the complainant submitted all the original documents for getting the claim as per the agreement.

The opposite party acknowledged the receipt of the documents filed by him. However, they delayed stating that the complainant did not produce the documents to the insurance company, the petitioner said. Later, the insurance company dismissed the claim. Mr Kar then filed a petition with the Hyderabad Consumer Disputes Redressal Forum seeking justice. However, the National Insurance Company Limited contented that as the complainant failed to furnish the required documents, the processing of the claim of the complainant was pending.

The Forum pointed out that though the complainant submitted all the documents, the company still did not process the claim submitted by him. The Forum stated that there was deficiency in service on the part of the insurance company in providing insurance services to the complainant. So, he was entitled for compensation. Moreover, the evidence stated that he suffered mental agony.
