HYDERABAD: The division bench of the Telangana High Court has upheld the action of the revenue authorities in giving possession and handing over 18 acres of land to Telangana State Financial Corporation (Formerly APSFC) in the Sy No. 307 of Gajularamaram village, Qudubullapur mandal, based on the suitable sketch and also a panchnama prepared on August 20, 2007.
Actually, the total extent of land available is Ac.441.13 guntas. Out of this, Ac. 318.27 guntas were taken possession of by the additional revenue divisional officer (land reforms) as it was surplus land. The remaining is private patta land. The state government leased out a total extent of ac.238.28 guntas of land to SFC, through G.O. Ms. No. 1100 revenue department dated 16.08.2007.
In the meantime, a certain extent of land which was surrendered to the revenue authorities was encroached upon by third parties, who laid it out and developed house site plots. Leaving that encroached land untouched, the revenue inspector prepared a suitable sketch and panchnama on 20.08.2007 and handed over possession of the land of Ac.238.28 guntas to SFC.
Challenging the sketch, the patta land owner and their buyers approached the High Court stating that the revenue inspector had included in that sketch the retainable non-surplus land.
Stating that only available land was 218,28 guntas in the said survey number, whereas the GO mentions 238 acres, the private parties also approached the High Court.
The division bench advised the private parties to approach the civil court based on the limitation for their rights.
