HC Issues Notice on Revenue-Forest Land Dispute

HYDERABAD: A two-judge bench of Chief Justice Alok Aradhe and Justice N.V. Shravan Kumar on Friday granted a writ appeal sought by the forest department. The appeal challenged a single judge order which directed the forest department to not interfere with the possession of land by Raheema Begum and seven others at Chinnadarpally, Hanwada mandal, Mahbubnagar. The appellant contended that the land was notified as reserved forest on which assignment pattas cannot be granted. The notification reserving the land as a forest came in 1951 and the petitioners were trying to interfere with their possession under the guise of assignment pattas. Counsel for the respondent contended that the land came under the revenue department and pattadar passbooks and Dharani entries were made in their favour by the tahsildar. There is a dispute with regard to possession between the revenue and the forest department, it was contended. The bench issued notice to the revenue department.

Woman gets bail in murder case

Justice K. Surender of the Telangana High Court granted bail to an agriculturist in a case of attempt to murder. The bail application was filed by B. Anusha (Accused No. 2) and her husband was arrayed as Accused No. 1. The prosecution said the complainant was coparcener of Accused No. 1 and they have property disputes. I was alleged that Accused No. 1 went to the house and assaulted the complainant. Petitioner’s counsel Rizwan Akhtar argued that only because the petitioner was the wife of Accused No. 1, she was falsely implicated. She has two minor children to take care of, as both parents are in jail. The court granted bail on condition of executing two sureties of Rs 25,000 each, and going to the Nawabpet police station every Monday and sign in the register for four weeks.

Defamation case returned to trial court

The XI Additional Chief Metropolitan Magistrate at Secunderabad will have to reconsider taking cognisance of a case of criminal defamation against a media organisation, the Telangana High Court said. Justice G. Anupama Chakravarthy directed the court to reconsider its order in this regard. The court was dealing with a petition to quash the case on the ground of procedural irregularities in the case filed against the publication house by Radha Realty Corporation Pvt Ltd. Counsel for the petitioner said the registry raised certain objections with regard to the complaint but without complying with the same the trial court judge directed CC No. 1311 of 2023 to be allotted to the case and issued orders taking cognisance, which is illegal. The court ought to direct the registry to issue the number according to the register and examine the witnesses before issuing the cognisance order.

Ex-official fails to stall probe

Justice T. Vinod Kumar Telangana High Court refused to entertain a writ petition by a retired special grade municipal commissioner questioning the issue of fresh proceedings against him. Petitioner B. Dev Singh challenged the proceedings issued by the commissioner and director, municipal administration, to the municipal commissioner to conduct inquire into irregularities of Rs 5 crore, lodge a police complaint and take steps for recovery of the amount. The petitioner said that an earlier abortive attempt was made to implicate him and the case was closed as a mistake of fact. The present direction was a clear case of double jeopardy. Counsel for the municipal commissioner the earlier investigation related to allegations of financial irregularities of about '80 lakh. The present direction was on much larger irregularities and the scope of the enquiry was wider. The respondent argued successfully that the petitioner could not take shelter under the earlier closure report by the criminal court. He pointed out that the present direction was based on an investigation report of the vigilance department.
