Supreme Court Rejects Petition for Action Against Brahmin Hate Speech
Mahalingam Balaji sought to withdraw his plea after the court questioned why only one community was protected from hate speech.

New Delhi: The Supreme Court on Friday declined to entertain a plea seeking recognition of hate speech targeting the Brahmin community as a punishable offence, with the petitioner withdrawing the case. A bench of Justices B.V. Nagarathna and Ujjal Bhuyan said there should be no hate speech against any community.
“We don't want hate speech against any community in the country. It depends on education, intellectual development, tolerance, and patience. Once everyone follows the fraternity, automatically there will be no hate speech,” Justice Nagarathna said.
The petitioner, Mahalingam Balaji, appearing in person, sought permission to withdraw the plea, which the court allowed.
“The petitioner, who has appeared in person, has sought permission to withdraw this petition. His submission is placed on record. The writ petition is dismissed as withdrawn,” the court said.
During the hearing, the bench questioned the need to seek protection for a specific community alone and observed that instances of alleged hate speech could be raised before appropriate forums. When the petitioner referred to criticism of the judiciary on social media, the court said it was not concerned with false attacks on the institution.
The plea had sought directions to the Centre and states to recognise hate speech against Brahmins as caste-based discrimination and take legal action, along with a probe into alleged campaigns promoting such content.
It also sought the constitution of a commission to examine historical incidents and measures for rehabilitation, and disqualification of public officials found engaging in caste-based hate speech.
The matter ended with the petition being dismissed as withdrawn.
