Follow Procedure Before Taking Any Action Against Anurag Colleges: HC Tells HYDRAA

Procure maps of lakes from Survey of India and NRSA, Govt urged

Hyderabad:The Telangana High Court on Friday suggested that the state government get maps from agencies like the Survey of India and the National Remote Sensing Agency at Sanathnagar for more clarity about the existing lakes and to recognise their full tank levels (FTL) and buffer zones.

Justice T. Vinod Kumar gave the suggestion while taking up the petition filed by Anurag University and Gayatri Educational Trust, which belong to the family of BRS MLA Palla Rajeshwar Reddy. They challenged the notices issued to them by the revenue authorities for demolition, on the ground that the structures were being constructed in the FTL of Nadem Cheruvu.

Two days back, the judge had directed government counsel to produce history of the lake to find out its area and its FTL and buffer zone.

Special counsel S. Rahul Reddy produced some records, which showed the extent of water spread in Nadem Cheruvu as 61 acres and constructions of the petitioner’s institution being within the buffer zone.

Rahul Reddy submitted that despite violations, the college management objected to the HYDRAA authorities, who then went to the educational institutions to take action. He said that that if the HYDRAA authorities intended to take action, it would put the petitioner on notice.

However, counsel for colleges submitted that the constructions were being made after securing approvals from the authorities concerned. At this time, Rahul Reddy sought a direction to the college management to not go ahead with the construction of some other buildings in the buffer zone of Nadem cheruvu.

The judge, while agreeing to the contention of special counsel, directed the petitioner not to make any constructions and made it clear that any permission, which the petitioner has obtained from the concerned authorities for construction in the buffer zone, is a fraudulent one and the petitioner would be inviting trouble if he went ahead with the construction.

The court also directed the HYDRAA and revenue officials to follow due procedure of law before they intend to demolish the petitioner’s institutions.
