HC Takes Up Petition on Polls to State Bar Council
Hyderabad: The Telangana High Court directed the Bar Council of India (BCI) and the state Bar Council to furnish the schedule of the elections to the latter by January 31.
The court was dealing with a writ petition seeking a direction to BCI and the Telangana Bar Council, about elections in the state as the term of the incumbent members was over.
According to the petitioner, an advocate, even the six-month extension given to the current body had ended. BCI counsel contended that verification of the certificates of practice was underway. The national council can extend the term of state councils beyond the period of five years, he said.
The court wanted to know if there were any such precedents. When counsel replied that the Supreme Court had transferred to itself matters concerning the aspect, senior counsel and former advocate general B.S. Prasad pointed out that the apex court observed in the order that it cannot by any means be construed as extending the terms of state bar councils.
