Legal Briefs | Student with 50kgs ganja in room enlarged on bail

Hyderabad: Justice Juvvadi Sridevi of Telangana High Court granted bail to a student from whose hotel room 50 kg of ganja was found. The judge was dealing with a bail application filed by Mohd Arif Aman Kumar. The petitioner contended that he was innocent and was falsely implicated in the case. Counsel for the petitioner argued that the contraband was seized from the hotel room, but not from the possession of petitioner. He also pointed out that he was enlarged on bail in a case of similar nature. As most part of investigation was complete, except filing of chargesheet, the petitioner prayed for grant of bail. The additional public prosecutor (APP) opposed the bail application stating that the petitioner is involved in the business of narcotic drugs and that another crime of similar nature was also pending against the petitioner. The judge observed that the contraband was seized from the hotel room, but not from the possession of petitioner. As most part of the investigation was completed, the judge deemed it a fit case for grant of conditional bail.


Plea on eligibility to Nims course

Justice B. Vijaysen Reddy of the Telangana High Court directed the Registrar of Nizam's Institute of Medical Sciences (Nims) to consider the application of a student applying to appear in entrance examination for a postgraduate course pursuant to the notification dehorse the issue of her domicile status. Jamboju Sharanya challenged the actions of the Nims registrar in not receiving her application. The petitioner alleged that though she was eligible and qualified as per law; her application was being denied on the ground of her domicile status. The registrar contended that the petitioner was not entitled to be considered to have domicile in Telangana as she had pursued her bachelor's degree from a college affiliated to the Bangalore University. The criteria determining domicile status stated that the candidate should have studied in the state of Telangana for a period of not less than four consecutive years. It was the case of the petitioner that she was born in Telangana and pursued her metric and intermediate education in the state. The petitioner stated that she relocated to Bengaluru for her bachelor's degree for three years and intended to pursue her postgraduate education in Telangana.


HC probes waste management unit


Justice T. Vinod Kumar of the Telangana High Court took on file a writ plea challenging the actions of GHMC, Ramky Group of Waste Management System and others, in establishing a garbage collection facility in an area earmarked for a green belt. The judge was hearing a writ plea filed by Virenderanath Pamulapati Choudary, who alleged that the facility managed by the Ramky Group was not only violating zoning regulations but was also causing significant environmental and public health concerns. The petitioner also alleged that the respondents had failed to address pollution and contamination affecting a nearby public park and failed to provide basic sanitation facilities for its workers, resulting in open defecation within the park premises. The petitioner also raised the issue of constant noise caused by dumpsters operating throughout the night, severely disrupting the petitioner’s living conditions. During the hearing, the judge questioned the government pleader representing the respondent authorities on how night-time operations could be permitted in a residential area and how waste disposal could be allowed in a zone designated as a green belt. The judge also sought explanation on the use of the area for defecation and dumping waste, despite being designated as a park. The government pleader sought additional time to get instructions from the respondent authorities. Accordingly, the judge posted the matter to next week for further hearing.

Notice to bank on interest deduction

Justice C.V. Bhasker Reddy of the Telangana High Court ordered notice to the State Bank of India (SBI) in a writ plea relating to a dispute over excess interest deduction. The judge took on file a writ plea filed by Kolli Graphics Private Limited challenging the actions of SBI, Kushaiguda branch, in deducting Rs 38.91 lakh as interest, which the petitioner alleged was in excess of the amount initially agreed upon. The petitioner contended that despite raising the issue with the banking ombudsman, the matter remained unresolved. The petitioner sought the refund of the deducted amount, along with 12 per cent interest which was deducted. The petitioner also sought compensation of an equal amount for intentionally causing business disruptions and financial loss. After hearing the petitioner, the judge ordered notice and posted the matter for further adjudication.
