Legal Briefs | Telangana accused of inaction against pubs creating noise pollution

HYDERABAD: A two-judge panel of the Telangana High Court took on file a writ plea against the state’s failure to take action against the for alleged noise pollution caused by Red Rhino Pub and Post Card Restaurant and Global Tapas Bar at Western Dallas centre, Hitec City road, in Hyderabad. The panel, comprising Chief Justice Alok Aradhe and Justice J. Sreenivas Rao, was dealing with a writ petition filed by Anand Dayama. It was the case of the petitioner that the authorities had failed to initiate action on his complaints that the respondents were functioning contrary to the Noise Pollution Regulation and Control Rules and the Environment Protection Act. The petitioner alleged that they were disturbing peace and tranquility in the complex with their continuous noise pollution. The petitioner further alleged that the authorities were permitting the respondents to run pubs in gross violation of the permissions issued to them. He sought a direction forthwith on withdrawing the licences and permissions granted to the respondents. The panel, considering the same, ordered notices and posted the matter for further adjudication.

HC to hear plea against SHO for ‘forcing’ his way in a child custody case

The Telangana High Court will hear a plea against the station house officer (SHO) of LB Nagar police for allegedly compelling a husband to hand over custody of the child to his wife under the guise of investigation. The petitioner told Justice B. Vijaysen Reddy that his wife left the marital home and flew out fo India. He contended that for three months the custody of the child was with him, and he was initiating steps to file a petition for guardianship. Counsel for the petitioner alleged that he was arrested but not remanded, though there were court orders against taking coercive steps when the petitioner was ready to cooperate with the investigation. The judge, after perusing the records, opined that the father picking up his child did not constitute an offence of kidnapping and, moreover, he was the natural guardian of the child. Per contra, counsel for the wife argued that police were following the law according to the provisions of the Bharatiya Nyaya Sanhita. The judge questioned counsel for the respondent whether he was interested in custody of the child or to get the petitioner arrested. However, the judge after hearing the parties directed the government pleader to seek instructions and directed both the parties to appear before the court on Saturday.

Notice to Medak audit officer in contempt case

Justice T. Madhavi Devi of the Telangana High Court ordered notice to the Medak district audit officer, engineer-in-chief of the state rural water supply division and others in a contempt case relating to sanction of pension and gratuity to a septuagenarian. The judge took on file a contempt case filed by B. Nagesh, a retired subordinate, who worked with the respondents. The petitioner alleged that the respondent authorities wantonly failed to comply with the order passed by the judge earlier in a writ plea. The judge had passed an order directing the respondent authorities to consider the pension and gratuity of the petitioner by taking into consideration his entire service, including in AP Scooters Limited, which was subsequently abolished. Its employees were shifted to various government departments and the petitioner was allotted to the rural water supply department where he joined as an office subordinate. The judge directed the respondents to sanction the gratuity and pension with simple interest at eight per cent per annum from the date of initial appointment to the date of payment after his retirement and pay the balance amount within three months. The petitioner alleged that despite such directions, the respondent failed to comply and was guilty of contempt. The judge ordered notice to the respondents and posted the matter for further adjudication.


Labour commissioner asked to promote employee on seniority basis

An aspiring assistant labour commissioner moved the Telangana High Court complaining of improper promotion to the cadre of deputy commissioner. Justice Pulla Karthik was dealing with a writ plea filed by G. Bala Narasimha Swamy seeking a direction to the state and director of labour to strictly implement the rule of qualification and eligibility for appointment to the positions of assistant labour officer and assistant commissioner of labour as clarified by the commissioner of labour. The petitioner alleged that one A. Rajeswaramma was promoted to the position of deputy commissioner in contravention of the GO dated August 31, 2024, and sought that it be set aside. After hearing the petitioner, the judge ordered notice to the unofficial respondent and passed an interim order directing the respondent authorities to consider the case of the petitioner for promotion as per the seniority list.

HC takes up suspension of TGSRTC conductor


The Telangana High Court will examine the legal sanctity of a showcause notice for removal and suspension order issued to a conductor for alleged unruly behaviour. Justice Pulla Karthik took on file a writ plea filed by K. Anji Reddy challenging the actions of the depot manager, TGSRTC, Korutla bus depot in Karimnagar district. Counsel for the petitioner argued that the action of the respondent authority demonstrated that it was a pre-determined move. Counsel also argued that the charges against the petitioner were minor in nature and were not backed by evidence, thus, the showcause notice and the suspension order were bad in law and liable to be set aside. The judge posted the matter for hearing of the respondent authorities.
