RERA orders builder to complete pending work

Hyderabad: The Telangana Real Estate Regulatory Authority (TG RERA) has ordered Bridge Constructions to complete pending works and rectify discrepancies within 30 days on a flat purchased by one Vineesh Kumar Thati or face penalties.

Thati booked the flat in March 2020 with a payment of Rs.83.69 lakh. He was assured the flat would be handed over to him in 18 months. However, the sale agreement signed in November 2020 moved the official possession deadline to May 2023, including a six-month grace period.

According to the complaint, several works are incomplete such as ceiling plastering, painting and installation of a storeroom door. There were variations in the dimensions of the balcony, leading to misuse of 55 square feet. Essential services like water, LPG and electricity, along with the occupancy certificate are yet to be provided.

The builder attributed delays to the Covid-19 pandemic, which it described as a force majeure event. The builder claimed the flat was completed in line with agreed standards and was ready for possession but the buyer had refused to take ownership.

RERA noted that delays caused by the pandemic could be justified, but the builder had not completed all the promised works as per the sale agreement.

"Complete the pending work, rectify all discrepancies and handover the flat within 30 days. Non-compliance with the order would lead to penalties under section 63 of the Real Estate (Regulation and Development) Act," the regulatory authority said. The case was closed with no penalties on either party.
