Islamabad: Pakistan’s Supreme Court on Friday annulled an order of the special court about addition of co-accused in Article-6 case against former Pakistan military ruler Pervez Musharraf.
The top court accepted appeal filed by its former Chief Justice Abdul Hameed Dogar against implicating him in treason trial of Musharraf.
A three-member bench overruled November 21, 2014 order of special trial court about the nomination of Mr Dogar as co-accused in the case.
The special trial had ordered authorities to include Mr Dogar, former law minister Zahid Hamid and former Prime Minister Shaukat Aziz as co-accused in the case.
The bench noted the high court or the special court did not have the prerogative to order the nomination of co-accused in the treason case. Discretion in this regard rests with the federation, it said.
The order added that the federation only considered Pervez Musharraf responsible for the imposition of November 3, 2007, emergency which led to the confinement of a number of superior court judges in their houses and sacking of over 100 judges, including then Chief Justice Iftikhar Mohammed Chaudhry.
The apex court also directed to complete the trial against Pervez Musharraf at the earliest.
A special tribunal headed by Justice Faisal Arab in a directive to the Federal Investigation Agency (FIA) on November 27, 2015 to investigate and submit a report about the role of former Prime Minister Shaukat Aziz, Justice Abdul Hameed Dogar and others in proclamation of November 3, 2007 emergency in the country.
Moreover, Pervez Musharraf in a plea to Supreme Court has sought permission to go abroad for medical treatment. In his petition he has prayed to the apex court to remove his name from the Exit Control List (ECL).
