Hyderabad:Biryani lovers from the city may soon get to relish the mouth-watering dish and other recipes at the popular Café Bahar Restaurant. The Supreme Court on Wednesday resolved the conflicts that arose between the eatery’s partners because of which it has remained closed since October 10, for the first time in its 51 years of existence.

The bench, headed by Chief Justice D.Y. Chandrachud, Justice J.B. Pardiwala and Justice Manoj Misra, reversed the Telangana High Court orders appointing Dantu Indu Sekhar, the resolution professional as the receiver of the restaurant.

The Apex court, upholding the decision of the district judge of commercial disputes, re-appointed Ali Asghar Bolooki, managing partner of the entity, as receiver to manage the day to day affairs of Café Bahar till the completion of the valuation process and settlement between the partners, who are also family members.

The Telangana High Court had set aside the appointment of Bolooki as the receiver and appointed a third person as receiver, a decision that was challenged in the Supreme Court.

The apex court faulted the High Court decision in appointing a resolution professional in what was essentially a family dispute. It also appointed a valuator to assess the valuation of assets held by the firm and fixed a timeline to complete the valuation. The court further appointed Justice Goda Raghuram as the arbitrator to resolve the issues, if any disputes arise in the distribution of assets.
