Blacklisting a GHMC contractor will only be limited to the civic body: HC

HYDERABAD: Justice T. Vinod Kumar of the Telangana High Court made it clear that a blacklisting of a contractor of GHMC can only apply to corporations and not to other government agencies.

The judge made the interim order in a writ petition filed by STUP Consultant, a contractor engaged by GHMC for quality certification of the Bahadurpura and Owaisi junction flyover.

Senior counsel L. Ravichander, appearing for the contractor, pointed out that the impugned proceedings were without the authority of law as the impugned blacklisting was for an unspecified period. He also pointed out that the blacklisting by the executive engineer was at the instance of the additional commissioner and a command performance on a vigilance report. STUP consultants contended that the said order was in violation of principles of natural justice and they did not record an appreciation of the response to the show cause notice.

Justice Vinod Kumar, relying on an earlier order on the limited powers of the GHMC, directed the corporation to respond but in the meanwhile made it clear that the impugned order would not have effect contracts outside of GHMC.
